1. Scope and eligibility
These Terms and Conditions govern your access to and use of Opendria, including our landing pages, user app interface, pricing menus, premium checkout scripts, conversational history services, and automated account registration features. You must be at least 16 years of age (or the minimum age of digital consent in your home country) to register an account or use Opendria.
2. Nature of Opendria (AI Dialogues)
Opendria provides highly creative, reflective, and educational conversational simulations inspired by historical, cultural, philosophical, scientific, and artistic figures. All conversational outputs, dialogues, opinions, dynamic memory adaptations, and relationship parameters are generated dynamically by Artificial Intelligence (AI) systems.
Accuracy Disclaimer: The simulated mentors do not represent real human agents or the actual, verified historical viewpoints of the respective figures. AI-generated text may contain historical omissions, creative fictionalization, inaccurate statements, or subjective biases. Opendria is designed purely for creative exploration, writing, reflection, and intellectual entertainment.
No Professional Advice: The service does not constitute, and must not be used as a substitute for, licensed professional, financial, medical, psychological, legal, tax, or academic advisory services. You should independently verify any critical statements or facts before acting upon them.
3. Safety and Crisis Use Disclaimer
Opendria is explicitly **not** an emergency response system, mental health clinic, therapist, suicide prevention line, or medical monitor. If you are experiencing a mental health crisis, feeling at risk of self-harm, or are in physical danger, immediately contact professional crisis response networks or call emergency services (such as **112** in Romania/EU, **911** in the USA, or **999** in the UK).
Opendria incorporates rate-limit filters and safety classifiers to detect high-risk prompts (such as statements of self-harm or violence). When triggered, the platform may immediately halt persona roleplay and provide a default list of safety hotlines. However, we do not guarantee the continuous detection of crisis prompts, and users accept full responsibility for seeking human professional crisis help when required. 4. Account registration and security
To access advanced conversations, dynamic memories, and purchase premium tiers, you must register a secure account:
- You agree to provide complete and accurate registration information (including a valid, accessible email address).
- You are solely responsible for maintaining the confidentiality of your session tokens, account passwords, and credentials.
- You must not sell, rent, lease, or share your account credentials with external third parties to bypass paywalls or technical limit quotas.
- We reserve the right to suspend, terminate, or restrict your account if we detect security breaches, suspected payment fraud, billing chargebacks, or violations of our acceptable use guidelines.
5. Subscriptions, Pricing, and the Waiver of the 14-Day Right of Withdrawal
We offer advanced features, expanded historical persona libraries, private memory retention, and increased conversational quotas through paid membership tiers (such as Scholar, Sage, and Oracle plans):
- Pricing & Charges (Material Terms): We clearly and conspicuously disclose all material terms of our subscription programs. All subscription prices are clearly displayed in United States Dollars (USD). Paid subscriptions are billed on a recurring basis (monthly or annually depending on your selection) and will automatically renew at the start of each billing cycle (frequency of charges) unless cancelled before the renewal deadline. The renewal fee will be charged to the payment method you provided during checkout.
- Automatic Renewal: Paid subscriptions automatically renew at the start of each billing period. Your card will be charged automatically at the recurring price you selected. To prevent future charges, you must cancel your subscription before the renewal deadline (which is the day before your next billing cycle begins).
- Simple Cancellation (FTC Compliant): The method to cancel your subscription is designed to be at least as easy, and offered through the same medium, as the sign-up process. You can instantly cancel your subscription at any time with a single click via your account dashboard's billing portal (without having to call or email), or by contacting us at contact@opendria.com. Upon cancellation, automatic renewal is deactivated, and you will retain premium access to Opendria until the final day of your currently paid billing cycle.

Waiver of the 14-Day Right of Withdrawal (Dreptul de Retragere):
[IMPORTANT FOR ROMANIAN & EU CONSUMERS] Under Article 16 lit. m of the Romanian Emergency Ordinance no. 34/2014 (OUG 34/2014) and Article 16(m) of the European Union Consumer Rights Directive (2011/83/EU), the statutory 14-day right of withdrawal does **not** apply to the supply of digital content which is not supplied on a tangible medium once performance has begun.
By completing your subscription checkout and requesting the immediate activation of your paid tier (Scholar, Sage, or Oracle), you provide your express prior consent for the digital service to begin immediately and explicitly acknowledge that you lose your 14-day statutory right of withdrawal (dreptul de retragere) once the supply of digital content has commenced. - Timing of Notice (Trials & Promos): If Opendria offers a free trial or promotional rate lasting more than 31 days, we will send you a clear renewal reminder notice via email between 3 to 21 days before the trial or promotional period ends, explaining how to cancel to avoid transition to a paid subscription.
- Refund Policy: Consequently, all subscription sales are final, and active billing periods are non-refundable. However, we want you to have a premium experience. In the event of confirmed technical errors caused entirely by Opendria, duplicate billing errors, or accidental unauthorized transactions, you may submit a refund request to contact@opendria.com within 48 hours of the charge, and we will assess it in good faith.
6. Acceptable Use Guidelines
You agree to use Opendria strictly in compliance with Romanian law, European Union law, and your local regulations. You explicitly agree not to:
- Attempt to scrape, reverse engineer, extract dialogue databases, or systematically copy persona prompts and system instructions from Opendria.
- Input prompts designed to generate instructions or methods for illegal acts, weapon creation, violence, child exploitation, self-harm, cyberattacks, or hate speech.
- Use the service to bypass authentication blocks, simulate payments, execute credit card fraud, or overload our API integrations with spam scripts.
- Impersonate Opendria staff or claim that simulated AI dialogue responses represent genuine statements from real living persons or authorized historical estates.
7. User Content and Privacy
You retain ownership of the prompts, text, and settings you submit to Opendria. You grant us the necessary technical rights to process, store, dynamic-cache, and display your prompts to deliver AI responses, secure your account, prevent server abuse, and maintain compliance. All data processing is governed strictly by our zero-AI-training guarantees in our Privacy Policy.
8. Intellectual Property
The Opendria interface, brand name, gold parchment scroll vector logo, website layout, customized system prompt configurations, database architectures, and styling structures are the intellectual property of Ungureanu Cristian (and our prospective corporate successor). No rights are granted to copy, frame, commercially resell, or redistribute Opendria platform assets without explicit, prior written permission.
8A. Copyright and Intellectual Property Infringement (DMCA & EU Safe Harbor)
Opendria respects the intellectual property rights of others. If you are a copyright owner or an authorized representative and believe that any text generated by our AI mentors, any persona avatar images, or any other content hosted on the platform infringes upon your copyright, you may submit a formal written notice of infringement to us at contact@opendria.com.
In accordance with the United States Digital Millennium Copyright Act (DMCA - 17 U.S.C. § 512) and Article 17 of the EU Copyright Directive / Digital Services Act (DSA), your notification must include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the allegedly infringed right.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list.
- Identification of the specific material claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to locate the material (e.g. the specific historical mentor name, character dialogue context, or screenshot).
- Information reasonably sufficient to permit Opendria to contact you, such as an address, telephone number, and email.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
Upon receiving a compliant takedown notice, we will act promptly to remove or disable access to the allegedly infringing material and coordinate in good faith to resolve the concern.
9. Availability, Features, and Updates
Opendria is currently provided in an early access validation stage on an "as-is" and "as-available" basis. We reserve the absolute right to alter character lists, adjust token limits, suspend selected historical personas, refine memory features, or suspend the server for technical upgrades or operational cost containment.
10. Consumer Rights & Dispute Resolution (ANPC / ODR)
If you are a consumer residing in Romania or the European Union, your mandatory statutory consumer rights remain fully intact. If you have a complaint regarding a billing dispute or a service issue, please contact us directly at contact@opendria.com. We are committed to responding to all formal consumer complaints within 14 calendar days.
In compliance with European Union and Romanian consumer protection regulations, we provide the official dispute resolution channels below:
- Romanian National Authority for Consumer Protection (ANPC): Romanian consumers have the statutory right to file a complaint regarding products or services. Official ANPC Website: https://anpc.ro.

11. Limitation of Liability
To the maximum extent permitted by applicable law (including Romanian Civil Code and consumer protection frameworks), Opendria and its operator, Ungureanu Cristian, shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of profits, data loss, business interruption, or emotional distress arising from your reliance on AI-generated dialogues, simulated persona advice, or temporary service interruptions.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the **laws of Romania**, without prejudice to any mandatory consumer protection laws in your country of residence that cannot be excluded. Any legal disputes arising from these Terms shall be submitted exclusively to the competent courts of **Timișoara, Romania**.
13. Changes to these Terms
We reserve the right to modify these Terms and Conditions at any time. The current version will always be published on this page, with the "Last updated" date adjusted at the top. Your continued use of Opendria following the publication of changes signifies your explicit agreement to the updated Terms.
